16. Governing Terms and Dispute Resolution

Any dispute arising out of or relating to these Terms or the Service shall first be submitted to good-faith negotiation. If unresolved within thirty (30) days, the parties agree to pursue resolution through binding arbitration before a mutually agreed neutral arbitrator. Nothing in this section prevents either party from seeking emergency injunctive relief where appropriate.

Failure by Domain to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. A waiver of any provision in one instance does not constitute a waiver in any future instance.
